Huntersville does not impose a maximum number of rental nights per year. NCGS 160D-1207 limits the authority of cities to cap STR nights unless applied uniformly to all rentals. STR operators can rent year-round subject to tax and zoning compliance.
Huntersville has not adopted any ordinance capping annual rental nights, non-owner-occupied days, or imposing minimum-stay requirements on short-term rentals. NCGS 160D-1207(c), reinforced by the NC Court of Appeals decision in Schroeder v. City of Wilmington (2022), prohibits local governments from imposing permitting, registration, or operational rules that single out short-term rentals unless applied uniformly to all residential rental use. As a result, operators in Huntersville can rent year-round. Pending state legislation (SB 291, 2025-26 session) would further restrict local authority to cap nights or require owner occupancy. Operators must still comply with the NC Vacation Rental Act definition (residential rental under 90 days), collect and remit the 4.75% state sales tax and Mecklenburg County's 2% local sales tax, and pay Mecklenburg's 8% room occupancy tax (one of the higher rates in NC). Platforms including Airbnb and Vrbo collect state and local sales tax automatically, but Mecklenburg occupancy tax compliance remains the operator's responsibility. HOAs under Chapter 47F may impose their own minimum-stay rules (commonly 30 days or longer in Huntersville communities like Birkdale and MacAulay), and those private covenants are enforceable even where the town is preempted.
No town cap to violate. Failure to remit Mecklenburg 8% occupancy tax: interest and penalties up to 25% of tax due plus criminal misdemeanor exposure under NCGS 105-236.
