Stockton has not adopted an annual nights-rented cap on short-term rentals. Operators may rent a residential unit for short-term stays year-round, subject to (a) collection and remittance of the 8% TOT under SMC Chapter 3.28, (b) obtaining a Stockton business license under SMC Title 5, and (c) compliance with applicable zoning under SMC Title 16 (Development Code). Title 16 Chapter 16.20 (Allowable Land Uses) and Chapter 16.40 (Standards for Specific Land Uses) regulate land uses by zoning district but currently treat residential rentals as a residential use rather than imposing a per-year night limit. Operators in the Magnolia Historic Overlay District or Aircraft Operations Overlay (Stockton Metropolitan Airport) should verify any overlay-specific restrictions.
Because no night cap exists, there is no fine for exceeding one. Operating without a business license or failing to remit TOT remains enforceable under SMC Title 5 and Chapter 3.28 (10%+10% delinquency penalties plus interest, plus possible misdemeanor charges).
