Olive Branch has no STR-specific occupancy cap. Article XII.5 of the city zoning ordinance requires each dwelling unit to provide at least 150 square feet for the first occupant and 100 square feet for each additional occupant, and sleeping rooms must be at least 70 square feet (50 square feet per additional occupant). Article II caps unrelated 'family' occupancy at four persons.
The Olive Branch zoning ordinance (Appendix A of the Code of Ordinances) does not regulate short-term rentals separately, so STR occupancy is governed by the citywide Maximum Occupancy Regulations in Article XII.5. That article requires each dwelling unit to have a minimum gross floor area of 150 square feet for the first occupant and 100 square feet for each additional occupant, and each sleeping room to have at least 70 square feet (50 square feet per additional occupant). Article II defines family as an individual, persons related by blood, marriage, or adoption, or a group of four or fewer unrelated persons living as a single household, so a rental occupied by unrelated guests is capped at four under that definition. Article II also defines a dwelling unit as occupied for owner use or rental on a weekly, monthly, or longer basis, which means hosts should confirm with Planning and Development at 662-892-9200 whether nightly rentals are permitted in their zoning district before booking guests.
Exceeding the floor-area occupancy thresholds in Article XII.5 or hosting more than four unrelated persons under the Article II family definition can trigger zoning enforcement by Planning and Development. Operating a nightly rental in a district that limits dwelling units to weekly-or-longer occupancy under Article II can result in cease-and-desist orders.
