Section 4:00(F) of Lynn's sign ordinance prohibits "Political signs in residential areas i.e., lawns, houses, on public buildings, trees or poles." As written, that bars residential political yard signs, but the U.S. Supreme Court held in City of Ladue v. Gilleo (1994) that a city cannot ban political signs at a person's own home, and Reed v. Town of Gilbert (2015) bars content-based sign rules. The residential provision is therefore effectively unenforceable against a homeowner's yard sign. Signs on public property, utility poles, and trees remain prohibited, and the ordinance does not apply in the Central Business District.
Under Section 11:00, each day a prohibited sign remains is a separate offense, with fines set by Inspectional Services. A homeowner's political yard sign is protected speech; signs on poles, trees, or public property may be removed.
