La. R.S. 33:4169.1 prohibits political subdivisions from enacting ordinances that regulate the use, disposition, or sale of auxiliary containers, defined to include reusable and single-use bags, cups, bottles, and packages. Local taxes or fees on these items are also barred. The statute reserves authority to the legislature, voiding municipal plastic bag bans, fees, and labeling requirements. Litter laws and voluntary recycling programs remain permissible.
Local ordinances violating the preemption are unenforceable; affected parties may seek declaratory or injunctive relief, and the state may withhold certain funding from non-compliant subdivisions.
