Minneapolis enacted its checkout-bag ordinance under Title 7 (Health and Sanitation) requiring retailers to charge a minimum five-cent fee on each single-use paper or plastic carryout bag, with the fee retained by the retailer. Customers receiving SNAP, WIC, or similar benefits are exempt from the fee. Minnesota later passed Minn. Stat. Β§471.9998, which limits new local bag bans, but the statute grandfathered existing ordinances enacted before 2021. Minneapolis's pre-2021 fee ordinance remains valid. Retailers must list the bag fee as a separate line item on receipts and cannot absorb or waive it.
Failing to charge the bag fee, hiding the charge in product pricing, refusing to provide reusable bag options, or denying the SNAP/WIC exemption can result in administrative fines and license action.
