NYSDEC enforces with progressive penalties: warnings, then fines escalating with subsequent violations. Limited hardship waivers exist for small businesses under specific revenue thresholds. Compostable and recyclable alternatives are required. Pre-packaged products manufactured outside New York and sealed at distribution remain exempt.
