Kentucky has not enacted an auxiliary-container preemption statute covering straws or other single-use food-service items. A 2018 preemption bill, SB 82, failed, and later single-use plastic bills proposed statewide restrictions that also did not pass. Because the Commonwealth neither restricts straws nor preempts local action, cities and counties retain authority to adopt on-request straw rules or bans under their ordinary powers. Separately, the federal ADA still requires food-service businesses to accommodate customers who need flexible plastic straws for a disability.
