Crystal Tree, Siena, Brookside Glen, and other Orland Park HOAs have updated covenants to comply with state law in recent years. Disputes between homeowners and HOAs over solar may be resolved through the courts or through mediation. Homeowners should provide their HOA with detailed plans early in the design process to avoid conflicts.
An HOA that improperly denies a solar installation may be sued by the homeowner. Courts may award attorney fees in successful solar rights cases. Homeowners are not subject to Village fines for HOA disputes; the Village does not enforce private covenants.
