HOAs cannot prohibit solar collectors unless restrictions are necessary for health, safety, or do not significantly increase cost or decrease efficiency, and allow comparable alternatives. Reasonable rules on placement, screening, and aesthetics that don't impair function may be enforceable. Wis. Stat. 700.41 further establishes solar access as a recognized property interest. Owners denied permission may seek declaratory judgment and damages.
