Unlike California, Texas, Florida, and other solar-access-law states, Michigan does not have a statute prohibiting HOAs from restricting residential solar panels. The Michigan legislature has periodically considered solar access bills (such as HB 4069 in prior sessions), but none have been enacted. Owners should carefully review the master deed, bylaws, and recorded CC and Rs before purchasing a home, and submit formal ARC applications when planning solar. Some newer associations are adopting solar-friendly policies voluntarily. Local zoning ordinances do not override private covenants. If denied, owners can pursue internal appeals, mediation, or civil suit in Wayne County Circuit Court.
