Wisconsin Statute 66.0401 applies to homeowners associations and condo associations, preempting deed restrictions and covenants that prohibit or significantly impair solar energy systems on owner property.
Under Wis. Stat. 66.0401(1m), the term "political subdivision" interpretations and Wisconsin case law extend solar access protections to private restrictive covenants and homeowner associations. HOAs cannot prohibit solar collectors unless restrictions are necessary for health, safety, or do not significantly increase cost or decrease efficiency, and allow comparable alternatives. Reasonable rules on placement, screening, and aesthetics that don't impair function may be enforceable. Wis. Stat. 700.41 further establishes solar access as a recognized property interest. Owners denied permission may seek declaratory judgment and damages.
HOAs enforcing prohibited restrictions face declaratory judgment, injunctions, attorney fee awards, and damages for system owners. Restrictive covenants conflicting with state law are void.
