Public Act 233 of 2023 (MCL 460.1221 et seq.) gives the Michigan Public Service Commission (MPSC) authority over siting of solar projects 50 MW or larger, wind farms 100 MW or larger, and energy storage facilities 50 MW or larger. Developers may apply directly to MPSC if local ordinances are more restrictive than state standards or are denied. Smaller residential and commercial rooftop solar remains under local building permits per the Stille-DeRossett-Hale Act (MCL 125.1504), which adopts the IRC and NEC for installation standards. The state energy code preempts conflicting local technical requirements.
