Application fees and consent fees vary by square footage and by sidewalk vs roadway configuration. Cafes serving alcohol need an updated NYS SLA license endorsement. Tents and enclosures are permitted with strict design standards, though fully enclosed structures are banned; roadway cafes must be open on at least one side. Heaters are allowed seasonally with FDNY approval. Noise cutoff hours vary by district but generally follow NYC Noise Code limits (see noise ordinance sub).
Operating without a Dining Out NYC license: DOT fines from 1,000 to 10,000 dollars per violation plus forced removal of tables, chairs, and structures. Blocking pedestrian path below 8 feet: additional 500 to 2,500 dollars. Non-compliant enclosures violate FDNY Fire Code with fines up to 10,000 dollars.
