Iowa Aircraft Noise Regulation Preempted by Federal Law

Under the Federal Aviation Act and the Airport Noise and Capacity Act, the federal government has exclusive control over airspace use, aircraft flight, and in-flight noise emissions. Neither Iowa nor its political subdivisions may regulate aircraft noise during takeoff, flight, or landing. Iowa Code Chapter 328 vests aviation oversight in the Iowa Department of Transportation and authorizes airport zoning to limit incompatible land uses near airports under sections 329 and 330, but actual aircraft sound levels remain a federal matter. Local airport sponsors may impose Part 161 restrictions only with FAA approval.

Local ordinances purporting to set decibel limits on overflights or restrict flight times outside FAA Part 161 process are unenforceable; federal courts routinely strike down such measures as preempted.
