Maine state law: commercial vehicle parking in residential zones

Maine state vehicle code (Title 29-A) sets statewide weight, length, height, and load-securement standards for commercial motor vehicles operating on public highways, defines and licenses commercial motor carriers (29-A MRS § 521 et seq.), governs commercial driver's license requirements (29-A MRS § 1251 et seq.), and addresses commercial-vehicle idling under Maine DEP air-quality regulations (06-096 CMR Chapter 154 — Limits on Idling of Motor Vehicles). The Maine Department of Public Safety enforces commercial-motor-carrier safety at weigh stations. However, Maine state law does NOT impose a uniform statewide rule on where commercial vehicles (semi-trucks, work trucks over 10,000 lbs GVWR, dump trucks, box trucks, commercial trailers, food trucks) may park overnight in residential zones. 30-A MRS § 3001 grants every Maine municipality broad home-rule authority to regulate commercial-vehicle parking in residential districts through zoning ordinances under 30-A MRS § 4352. Typical Maine municipal residential-zone limits prohibit overnight parking of commercial vehicles over 10,000 lbs GVWR, semi-tractors, commercial trailers over a specified length (often 20 or 25 ft), unhitched dumpsters, and outdoor storage of construction equipment in front of single-family homes. Maine DEP's idling limit (06-096 CMR Ch. 154) generally caps non-emergency commercial idling at 5 minutes per hour statewide.

Anti-idling violations under 06-096 CMR Ch. 154 are enforced by Maine DEP with civil penalties typically $100-$500 per violation. Commercial driver's license / FMCSA violations are enforced at state weigh stations with federal penalty schedules. Municipal residential-zone commercial-vehicle parking violations are civil offenses enforced by the Code Enforcement Officer or local police, with typical $100-$500 fines per day, plus tow authority under 29-A MRS § 2074.
