Portland's Chapter 28 (Traffic and Motor Vehicles) does not impose a blanket overnight ban on commercial vehicles citywide, but several provisions tightly regulate where and how long commercial and oversized vehicles may park. Sec. 28-56(b) (Ord. No. 183-97, 1-22-97) governs truck-loading zones: 'No person shall stop, stand or park a commercial vehicle for any purpose or length of time other than for the expeditious unloading and delivery or pickup and loading of materials in any place marked as a truck loading zone during the hours from 6:00 a.m. to 6:00 p.m. Use of a truck loading zone shall be limited to vehicles with commercial or combination plates from any state and in no case shall the stop for loading or unloading of materials exceed thirty (30) minutes without a special street occupancy permit from the city.' Sec. 28-58(a) prohibits parking any motor vehicle exceeding 20 feet in length on any public street, public way, or publicly owned property in a residential-zoned area during November through March, with exceptions (Sec. 28-58(b)) for active deliveries, passenger pickup/discharge, utility/emergency/governmental service to abutting properties, and active street construction/repair. Sec. 28-57 forbids on-street parking for the principal purpose of (a) display for sale, (b) washing/greasing/repair (except emergency), (c) advertising, or (d) storage β with 'storage' defined as continuous parking in the same place for more than 10 consecutive days. The waiver-fee schedule kept under Sec. 28-51 includes 'Overtime Commercial Vehicle Zone' ($25.00) and 'No Parking / Dual Rear Wheels' fines. Chapter 28 does not adopt a separate definition of 'commercial vehicle' but defers under Sec. 28-1 to 29-A MRS Β§ 101 (which uses registration plate classification). Maine state law 29-A MRS Β§ 2068 establishes baseline parking rules statewide; Portland's home-rule ordinance imposes the more restrictive layered limits described above.
Violations are civil parking citations issued under Sec. 28-43 and Sec. 1-15. Waiver-fee schedule items most relevant to commercial vehicles include: 'Overtime Commercial Vehicle Zone' at $25.00, 'No Parking / Dual Rear Wheels' (escalating to $200.00), item 15 (vehicle 20'+ in residential area Nov-Mar), and item 13 (storage/abandoned 10 consecutive days). Loading-zone overstay carries a $25 waiver fee per the Sec. 28-51 schedule. Vehicles parked in violation may be towed under 29-A MRS Β§ 2074. Vehicles abandoned beyond 10 days additionally fall under Maine's statewide abandoned-vehicle framework at 29-A MRS Β§ 1854 β auto-repair or storage operators must notify the Secretary of State within 14 days of the earliest unpaid-charge date.
