Maine state law: electric vehicle charging infrastructure

Maine's electric-vehicle policy framework is incentive-driven rather than mandate-driven. Per 35-A MRS § 10126 (Electric vehicle accelerator), the Efficiency Maine Trust administers an electric-vehicle accelerator program providing rebates for the purchase or lease of qualifying electric vehicles and grants for the installation of EV charging infrastructure. The statute does not require any residential or commercial property to install EV charging. EV-readiness wiring requirements for new residential and commercial construction are governed by the Maine Uniform Building and Energy Code (MUBEC) under 25 MRS § 2451, which adopts the International Energy Conservation Code, the National Electrical Code (NFPA 70) — including Article 625 on electric vehicle power transfer systems — and the IRC/IBC. There is no Maine statewide EV-charging-station-installation mandate analogous to CalGreen Title 24 Part 11 (California) or Washington's HB 1112. The Maine Department of Environmental Protection administers the Volkswagen Mitigation Trust for public DC fast-charging deployment along corridors. Beyond the state floor, municipalities may impose stricter EV-charging requirements (minimum percentage of new-construction parking spaces wired for Level 2, EV-only stalls in municipal lots, expedited permitting for residential chargers) under 30-A MRS § 3001 home-rule authority. The mandatory Shoreland Zone (38 MRS § 435 et seq.) constrains new commercial EV-charging installations within 250 ft of protected waters.

There is no state-level penalty for failing to install EV charging. Building-permit violations for non-compliant Level 2 or DC-fast charger installations (improper conduit, panel capacity, GFCI, or NEC Article 625 violations) are enforced by the local Code Enforcement Officer under MUBEC and the State Electrical Examining Board (32 MRS § 1311 et seq.) with typical $200-$1,000 fines plus permit revocation and re-inspection.
