Maryland Amplified Sound Decibel Limits

Maryland treats amplified music as a regulated noise source under COMAR 26.02.03.02. Sound levels at the receiving property line cannot exceed 65 dBA in residential zones during daytime or 55 dBA at night. Commercial venues face 67/62 dBA limits. Outdoor concerts and special events typically require a noise variance issued by MDE or the local jurisdiction. The state regulation preempts any attempt by venues to claim First Amendment immunity from decibel-based standards, since the rules are content-neutral. Local ordinances may add specific amplified-sound restrictions but must respect the state ceiling.

Civil penalties up to $10,000 per day under Environment Article 1-404. Repeated venue violations may lead to license review by local liquor or entertainment boards.
