Minnesota Hot Tub and Public Spa Regulations

Public hot tubs at hotels, condominiums, and clubs must obtain a Minnesota Department of Health license under Minn. Stat. 144.1222 and follow operating standards in Minn. R. 4717.2150 including maximum water temperature of 104 degrees, free chlorine minimum of 2.0 ppm, and posted bather time limits. Drains must comply with the federal Virginia Graeme Baker Pool and Spa Safety Act with anti-entrapment covers. Residential hot tubs are governed by the State Building Code via Minn. R. 1303 and require electrical permits under Minn. Stat. 326B.31, with a locking ASTM F1346 safety cover satisfying barrier rules.

Unlicensed public spa operation is a misdemeanor. MDH can order immediate closure for excessive temperature, drain noncompliance, or contaminated water with daily penalties accruing.
