Outdoor hot tubs must have either a locking rigid safety cover rated to support the weight of a child or be enclosed by a barrier fence meeting the same four-foot height, self-closing gate, and self-latching requirements as swimming pool enclosures. If the hot tub is located within a fenced pool area, the existing pool barrier may satisfy the requirement provided all gates remain self-closing and self-latching. Indoor hot tubs are exempt from fencing requirements but still require the electrical permit and proper ventilation to prevent moisture damage and air quality issues. Hot tubs must comply with zoning district setback requirements and cannot be placed in required yard setbacks without a variance. Water from hot tub draining must be discharged to the sanitary sewer system or to a permeable surface area on the property and must not be directed onto neighboring properties or into the storm sewer system. The federal VGB Act applies to hot tub and spa drain covers, requiring ASME/ANSI A112.19.8 compliant anti-entrapment covers. Portable plug-in hot tubs under 120 volts may not require a separate electrical permit but must still have GFCI protection on the circuit.
