Nevada Open Burning Permits and Air Quality Rules

Under NRS 445B.500 and NAC 445B.22037, open burning of waste, vegetation, or land-clearing debris generally requires an air quality permit from the Nevada Division of Environmental Protection (NDEP) or the local air quality agency. In Clark County (DAQ) and Washoe County (AQMD), separate stringent rules apply with mandatory burn-day notifications. Burning of garbage, treated wood, plastics, tires, and most household waste is prohibited statewide. Agricultural burning may be exempt with notification. Wildfire-prone areas under Nevada Division of Forestry jurisdiction require additional fire permits under NRS 527 and may be suspended during red flag warnings.

Unpermitted open burning is subject to administrative penalties up to $10,000 per violation under NRS 445B.640, plus suppression cost recovery if a wildfire results.
