Nevada Dillon Rule Restricts Local Rent Control

NRS Chapter 118A governs landlord-tenant relations statewide and does not authorize municipal rent control. Under the Dillon Rule, Nevada local governments may exercise only powers the legislature expressly grants, so blanket rent caps are generally outside city authority. NRS 118A.300 requires only 60-day advance notice for rent increases on month-to-month tenancies (45 days for periodic tenancies less than a month) without limiting the amount. North Las Vegas adopted a narrowly tailored 2016 ordinance limited to certain pre-1995 apartments, which courts upheld due to its limited scope, but a broader cap would likely be preempted.

Cities adopting unauthorized rent control face legal challenge and judicial invalidation. Landlords who fail to give statutory NRS 118A.300 notice cannot enforce the increase until proper notice is provided.
