Nevada Has No Rent Control and No Express Preemption

Nevada's landlord-tenant chapter, Nev. Rev. Stat. Chapter 118A, contains no statewide rent cap and no provision that either grants or forbids local governments the power to control rents, leaving the issue unaddressed by express statute. Nevada is a Dillon's Rule state, so local authority to regulate rents is legally uncertain absent an explicit grant, and the Legislature has repeatedly debated but not settled the question. As a practical matter, no Nevada municipality operates a rent-control program. The only direct statutory limit on rent changes is notice: under Nev. Rev. Stat. § 118A.300, a landlord "may not increase the rent payable by a tenant unless the landlord serves the tenant with a written notice, 60 days or, in the case of any periodic tenancy of less than 1 month, 30 days in advance" of the increase.

There is no statutory cap on rent in Nevada, so a landlord faces no penalty for the amount of an increase. The enforceable limits are the required advance written notice under NRS 118A.300 and the terms of an existing lease; raising rent without proper notice makes the increase ineffective.
