New York Propane Storage Under Uniform Fire Code

Executive Law Article 18 establishes the New York State Uniform Fire Prevention and Building Code, codified at 19 NYCRR Parts 1219 to 1228. The Fire Code of New York State adopts NFPA 58 by reference, requiring residential propane cylinders over 125 gallons water capacity to meet specific setback distances from buildings, property lines, and ignition sources. Tanks must be installed by certified technicians, stored upright, and protected from vehicle impact. Localities may adopt more stringent rules but cannot fall below the statewide minimum.

Code violations are prosecuted as misdemeanors under Executive Law Section 382, carrying fines up to $1,000 per day per violation plus possible imprisonment up to one year for willful noncompliance.
