IFC Section 6109.7 prohibits LP-gas storage inside dwelling units and restricts cylinders on combustible balconies of multifamily Group R-2 structures (each balcony limited to a single 20-pound cylinder serving a listed grill). Gas piping and appliance installation must additionally comply with 19 NYCRR Part 1224 (the New York adoption of the 2020 International Fuel Gas Code). Building permits for tank installations and gas piping are issued by the Town of Colonie Building Department, and an LP-gas installer must be qualified under NFPA 58 Chapter 4 and any applicable contractor registration. Tanks must be set on a non-combustible pad, protected from vehicle impact where exposed, and labeled with the proper NFPA 704 placard. Underground tanks must additionally comply with NFPA 58 Section 6.6 burial-depth and corrosion-protection requirements. The fire code official may require an IFC operational permit under IFC Section 105.6 for any LP-gas storage above the residential aggregate threshold or for any commercial use.
Failure to obtain a required IFC operational permit, exceeding the 500-pound aggregate residential limit, or violating NFPA 58 setbacks are IFC violations enforced by the Colonie fire code official. Civil penalties under NY Executive Law Section 382 can reach up to $1,000 per day per violation, and tanks installed without permits may be ordered removed at the owner's expense. Gas-piping violations under 19 NYCRR Part 1224 are enforced through the Uniform Code permit process administered by the Colonie Building Department. Recklessly causing a fire or explosion through unlawful LP-gas storage can support criminal charges under NY Penal Law Article 150 (Arson) or Section 145.10 (Criminal mischief).
