New York is one of the most restrictive states in the country for consumer fireworks. NY Penal Law Section 405.00(2) defines 'fireworks' broadly to include any 'combustible or explosive composition' designed to produce a visible or audible effect by combustion, deflagration, or detonation, and makes the offer for sale, sale, furnishing, or possession of fireworks a violation, with felony enhancements for repeat offenders or commercial sales. The Sparkling Devices Law, enacted as Chapter 477 of the Laws of 2014 and codified at NY Penal Law Section 270.00 and General Business Law Section 156-h, carves out a narrow category of 'sparkling devices': ground-based or hand-held devices that produce a shower of colored sparks or a colored flame, audible crackling or whistling noise, and smoke. The list specifically includes cylindrical fountains, cone fountains, wooden sparklers/dipped sticks, novelty items such as 'snakes' and 'glow worms,' and party poppers. The law expressly excludes any device that explodes, leaves the ground, or has more than 500 grams of pyrotechnic composition (cylindrical fountains capped at 75 grams, cone fountains at 50 grams). Section 156-h(2) allows each county legislature to opt in by local law. Albany County has opted in, so sparkling devices may be sold from June 1 through July 5 and December 26 through January 2, and may be used year-round by persons 18 or older. Use on public property, on the property of another without consent, or in a manner that endangers life or property remains prohibited. All aerial fireworks (mortars, shells, Roman candles), firecrackers, and bottle rockets remain illegal Class A misdemeanors under Penal Law 270.00. The Town of Colonie does not have a separate local fireworks chapter; enforcement rests with the Colonie Police Department and the NY State Police, and seized fireworks are subject to forfeiture under Penal Law Section 405.00(4).
Possession or use of unlawful fireworks (aerial devices, firecrackers, bottle rockets, Roman candles) is a Class B misdemeanor under NY Penal Law Section 270.00 (Unlawfully possessing or selling noxious matter / illegal fireworks), punishable by up to 90 days in jail and a fine of up to $500. Possession of more than $50 worth of unlawful fireworks is a Class A misdemeanor (up to 1 year jail, $1,000 fine). Sale of fireworks without authorization is a Class A misdemeanor for a first offense and a Class E felony for subsequent offenses. Causing injury or property damage with fireworks can support additional charges including Reckless Endangerment (Penal Law Article 120) and Arson (Penal Law Article 150). Sparkling devices used by a person under 18 or sold without the proper retail permit are also seizable.
