Per the City of Phoenix Fire Department, 'The Phoenix Fire Code prevents the sale and use of consumer fireworks in the City of Phoenix. However, Arizona State Law supersedes this requirement during specific dates and allows the sale and use.' Because Maricopa County has a population over 500,000, ARS 36-1606(A)(1) lets Phoenix prohibit permissible consumer fireworks except on the state-listed dates. Legal SALE dates are April 25-May 6, May 20-July 6, December 10-January 3, and the Diwali window; legal USE dates are May 4-May 6, June 24-July 6, December 26-January 4, and the second/third days of Diwali. Permissible items are limited to ground and hand-held sparkling devices (sparklers, fountains, ground spinners, smoke devices). Skyrockets, bottle rockets, aerial shells, firecrackers, and anything that rises into the air or explodes are prohibited at all times. Phoenix may also prohibit use between 11:00 p.m. and 8:00 a.m. (except New Year's and July 4) and within one mile of its mountain preserves during a Stage I or higher fire restriction.
Selling or using consumer fireworks outside the state-authorized dates, or using any prohibited aerial/exploding device at any time, violates the Phoenix Fire Code and is enforceable by the fire code official and Phoenix Police. Novelties (snappers, party poppers, snakes, glow worms, sparklers) are exempt and allowed at all times under ARS 36-1606.
