Arizona state statute (ARS Β§36-1606) preempts Gilbert from banning consumer fireworks during designated periods. However, Gilbert prohibits consumer fireworks during all other times of the year. Legal use periods are May 4-6, June 24-July 6, and December 24-January 3 on private property with owner permission only. Fireworks are prohibited on all public property including parks, rights-of-way, and roads. Use is restricted between 11:00 PM and 8:00 AM, with exceptions on July 4 and New Year's Eve (until 1:00 AM). During Stage 1 or higher fire restrictions, fireworks are prohibited within one mile of preserves and parks. Individuals using fireworks outside legal dates face a $1,000 fine.
