North Dakota Public Swimming Pool Safety and Health Rules

Public swimming pools, including those at hotels, apartments, schools, and waterparks, require an annual Department of Health permit under NDCC 23-19. Operators must conduct daily disinfectant and pH testing, maintain free chlorine residual between 1.0 and 5.0 ppm, and keep written logs available for inspection. Federal Virginia Graeme Baker Pool and Spa Safety Act compliance is required, with anti-entrapment drain covers and dual main drains. Pools must post depth markers, capacity, and emergency contact signs. Lifeguards are required for pools over a defined size unless No Lifeguard On Duty signs are properly posted. The state inspects pools annually. These public pool standards preempt weaker local rules.

Operating without a permit, failing inspections, or unsafe conditions can result in closure orders, civil penalties, and license revocation.
