Fargo Ordinance No. 5425 requires every private swimming pool holding water more than 24 inches deep to be enclosed by a barrier at least 48 inches tall and located at least 4 feet from the outside of the pool. Gates must be self-closing and self-latching, with the latch release on the pool side if mounted below 54 inches.
Fargo's residential pool safety rules, codified through Ordinance No. 5425 and reflected in the city's adopted IRC Appendix G (via Chapter 21 of the Fargo Municipal Code), apply to any private swimming pool capable of holding water more than 24 inches deep. The barrier must be at least 48 inches in height measured from the exterior side and must stand at least 4 feet away from the outside edge of the pool itself, so a typical fenced backyard alone does not satisfy the rule unless it meets both the height and offset criteria. Every gate or door in the barrier must be self-closing and self-latching: when released from a 6-inch open position the gate must positively close and latch on its own. If the latching mechanism is less than 54 inches above the bottom of the gate, the release must be located on the pool side of the gate, and any opening within 18 inches of the release must be no greater than a 1/2-inch sphere. An existing pool enclosure may not be removed, replaced, or altered in a way that reduces its effectiveness as a safety barrier. New residential pools and most spa or hot tub installations require a building permit from the City of Fargo Inspections Department; verify trade permits and current fees with Inspections at 701-241-1561.
Failing to enclose a pool meeting the 24-inch depth threshold, or removing/altering an existing enclosure to reduce its effectiveness, violates Ordinance No. 5425 and can trigger an order to install or restore a compliant barrier.
