Garage conversion rules in Fargo, ND β sometimes called garage-to-ADU or accessory living unit conversions β govern permits, ceiling height, egress, and parking replacement.
Converting a Fargo garage to habitable living space requires a residential building permit from the City of Fargo Inspections Department, plus electrical, plumbing, and mechanical permits as applicable. The work must satisfy IRC egress, fire-separation, and energy-code requirements adopted in Fargo Municipal Code Chapter 21, plus zoning compliance with Land Development Code Chapter 20.
Fargo's Inspections Department requires a permit for any new construction, addition, remodeling project, or structural alteration, including garage conversions to living space. Plans must show the proposed use, framing, insulation, mechanical and electrical changes, and emergency escape and rescue openings. Each new sleeping room and any habitable basement space must include at least one openable emergency escape and rescue (EERO) window or exterior door per the IRC as adopted in Chapter 21 of the Fargo Municipal Code, with a sill height no more than 44 inches above the floor (48 inches if below grade in a single-family dwelling). Fargo applies a local amendment requiring a minimum 30-inch by 16-inch permanently attached platform in any window well that reduces the vertical depth to no more than 42 inches below the top of the well. If any portion of the original garage remains attached to the dwelling, the IRC fire separation must be maintained: at least 1/2-inch gypsum board on the garage side, with door openings between garage and residence served by a 1-3/8-inch solid wood, solid/honeycomb-core steel, or 20-minute fire-rated door. Zoning under Land Development Code Chapter 20 must still allow the resulting use, and any required off-street parking lost to the conversion must be replaced. Adding a kitchen or otherwise creating a second dwelling unit (an ADU) requires separate zoning review through Planning at 701-241-1474.
Converting a garage to living space without permits can prompt a stop-work order, an order to restore the garage or obtain after-the-fact permits, and may bar the space from legal occupancy until egress, fire separation, and energy code requirements are verified by inspection. Confirm civil-fine amounts with Fargo Inspections at 701-241-1561.
