Fargo Ord. No. 5425 (April 2024) requires barriers around any temporary or permanent pool or hot tub holding water 2 feet (24 inches) deep or more. Barrier must be at least 48 inches tall and located at least 4 feet from the outside of the pool, with self-closing/self-latching gates.
Fargo Municipal Code Ch. 13, Art. 13-10 (Recreational Aquatic Facilities) and Inspections Department rules implement IRC Appendix G/AG105 standards adopted statewide. Updated April 2024 by the City Commission, the rules now apply to temporary inflatable/soft-sided pools and hot tubs in addition to permanent pools. Self-latching device must be on the pool side of the gate when located less than 54 inches above the bottom of the gate. Gates must positively close and latch when released from a 6-inch open position.
