Oklahoma Tobacco Flavor Regulation and Local Preemption

Oklahoma has no general prohibition on flavored vapor products, menthol cigarettes, or flavored cigars beyond federal Food and Drug Administration restrictions on certain cartridge-based e-cigarettes. State law concentrates tobacco regulation at the legislative level, and statutory preemption provisions in Title 63 generally preclude cities and counties from imposing flavor bans that conflict with state policy. Retailers are still bound by federal flavor restrictions on closed-system e-cigarettes and by age and permitting requirements under Oklahoma law.

Selling federally banned flavored cartridge e-cigarettes or violating state permitting and age laws can lead to enforcement actions, even absent a state flavor ban.
