Tulsa has no local flavored tobacco or e-cigarette ban. Oklahoma Statutes Title 63, Section 1-229.20 broadly preempts cities and counties from regulating the sale, distribution, advertising, sampling, promotion, display, possession, licensing, or taxation of tobacco, nicotine, and vapor products beyond state law. The only municipal flavor restrictions allowed are those mirroring federal/state rules.
There is no flavored tobacco or flavored e-cigarette ban in the City of Tulsa, and the city has no legal authority to enact one. Under Oklahoma Statutes Title 63, Section 1-229.20 (Regulation by agencies or political subdivisions restricted), the Oklahoma Legislature has expressly preempted state agencies and political subdivisions, including municipalities and counties, from adopting any orders, ordinances, rules, or regulations concerning the sale, purchase, distribution, advertising, sampling, promotion, display, possession, licensing, or taxation of tobacco products, nicotine products, or vapor products, except as expressly authorized by state law. The only narrow exceptions allow political subdivisions to: (1) exercise their lawful zoning and land-use authority over where tobacco/vape retailers may locate, and (2) enforce fire-code provisions on smoking that are substantially similar to nationally recognized fire codes. Oklahoma has reaffirmed this preemption multiple times, and it has been used to block local smoke-free workplace ordinances, local youth-access rules stricter than state law, and local flavor bans. The applicable flavor restriction in Tulsa is therefore the federal U.S. Food and Drug Administration rule that prohibits the manufacture, distribution, or sale of cartridge-based e-cigarettes (closed-system pods) in flavors other than tobacco or menthol, plus the federal ban on characterizing flavors (other than tobacco or menthol) in cigarettes. Adult-only tobacco/vape retail stores, schools, and city-owned property may have their own access rules, and OAC enforcement of underage sales (under 21) is handled by the Oklahoma ABLE Commission. Sellers should confirm any zoning restrictions on tobacco retailer location with Tulsa Development Services.
Because Oklahoma Statutes Title 63, Section 1-229.20 preempts local flavor regulation, no Tulsa-issued citation can be issued for selling flavored tobacco, flavored e-cigarettes, or flavored vapor products beyond what state and federal law restrict. Federal flavor restrictions on cartridge-based e-cigarettes are enforced by the U.S. Food and Drug Administration, and underage sales (sales to anyone under 21) are enforced by the Oklahoma ABLE Commission, not the City of Tulsa.
