South Dakota state law: residential fence height limits

The South Dakota Codified Laws contain no general residential fence-height ceiling. SDCL Chapter 40-28 (Partition Fences) governs the open-range agricultural 'lawful fence' standard — barbed wire on substantial posts sufficient to turn livestock — but this is NOT a zoning rule and does not constrain urban residential fences. Authority to set residential height limits is delegated to municipalities under SDCL Chapter 11-4 (the Municipal Zoning enabling act) and to counties under SDCL Chapter 11-2 (County Zoning) in unincorporated areas. SDCL 9-29-1 gives every statutory municipality police-power authority to regulate for the 'health, safety, morals, and general welfare of the community,' which is the textual hook for fence-zoning ordinances. Home-rule cities (Sioux Falls, Rapid City, Watertown) operate under SDCL 6-12 charters with broader implied authority. Because there is no preemption, ordinances vary substantially across the state's 311 municipalities.

There is no state-level fence-height penalty. Enforcement is by municipal or county zoning citation under local code, typically requiring the owner to lower or remove the noncompliant fence after written notice. Continued violation may carry per-day fines under local nuisance-abatement provisions authorized by SDCL Chapter 9-32 (municipal nuisance powers).
