South Dakota state law: retaining-wall permit and engineering rules

South Dakota has no statewide retaining-wall statute and no uniform statewide building code. The State does not adopt a single edition of the I-Codes; each jurisdiction adopts and amends the IRC, IBC, and other I-Codes independently under building-code authority granted by SDCL Chapter 11-4 (municipal) and SDCL Chapter 11-2 (county). Under the model IRC Section R404 and IBC Section 1807, retaining walls more than 4 feet in height (measured from the bottom of the footing to the top of the wall) typically require a building permit and engineered design stamped by a South Dakota-licensed professional engineer, with consideration of frost depth (typically 42-48 inches in SD), drainage, surcharge loads, and soil conditions. Walls 4 feet or shorter and not supporting a surcharge are usually exempt under IRC R105.2. Local jurisdictions may impose stricter standards. Walls in floodplains additionally require review under locally adopted floodplain-management ordinances (federal NFIP compliance, enforced under SDCL Chapter 11-2 and SDCL Title 46A).

Failure to obtain a required retaining-wall permit results in a stop-work order, after-the-fact permit fees (often double the standard fee), required engineering review, and potential demolition of the wall if it cannot be brought into compliance. Penalties are imposed by the local building department under local code, with appeals to the local board of adjustment under SDCL 11-4-21 (cities) or SDCL 11-2-49 (counties).
