South Dakota state law: industrial and commercial noise

There is no South Dakota Codified Law that fixes a statewide industrial or commercial decibel cap at the residential property line, no statewide OSHA equivalent for community noise (OSHA's 29 CFR 1910.95 is a federal workplace standard, not a community standard), and no statewide industrial buffering or setback rule. Three layered authorities apply: (1) SDCL 22-18-35 makes 'unreasonable loud noise' a Class 2 misdemeanor when it 'intentionally causes serious public inconvenience, annoyance, or alarm'; (2) SDCL 21-10-1 defines a nuisance as any act which 'annoys, injures, or endangers the comfort, repose, health, or safety of others,' providing the civil-injunction framework; and (3) SDCL 9-29-1 grants municipalities broad police-power authority over industrial noise, supplemented by SDCL Chapter 11-4 (municipal zoning) which allows cities to adopt performance standards for industrial zones (typical: 65-70 dBA at residential property line daytime, 55-60 dBA nighttime). Sioux Falls and Rapid City exercise this authority through their zoning codes and home-rule SDCL 6-12 charters.

SDCL 22-18-35 disorderly conduct (Class 2 misdemeanor): up to 30 days in jail and up to a $500 fine. SDCL 21-10-1 nuisance: civil injunction and damages in circuit court. Municipal performance-standard violations: stop-work orders and civil fines, typically $100 to $1,000 per day of continuing violation.
