Sioux Falls Code ยงยง 93.001โ93.003 (Chapter 93: Nuisances, Noise Regulations) set maximum L90 sound pressure levels by receiving land use district. Industrial sources may not emit L90 levels that exceed the limit for the adjacent receiving zone. Residential receiving zones are capped at 55 dBA (daytime) and lower at night; commercial zones at 65 dBA; industrial-to-industrial transfers allow higher levels. Measurement must be taken at the property line of the receiving land use per ยง93.004. Sound permits under ยง93.007 may allow temporary exceptions. Enforcement is by the Health Department.
Violations of ยงยง93.002โ93.008 are declared a nuisance; fines up to $500 and/or 30 days imprisonment per offense; each day is a separate violation; injunctive relief also available.
