South Dakota state law: leaf blower rules

SDCL contains no leaf-blower-specific statute. South Dakota has not enacted any analog to California AB 1346 (2021) phasing out small off-road gasoline engines, and SDCL Title 34 (Public Health) imposes no equipment-noise dBA cap on leaf blowers, mowers, or string trimmers used on residential property. Any regulation of two-stroke gas blowers, hour-of-day operation, or property-line dBA levels for lawn equipment is a strictly local matter. SDCL 9-29-1 supplies the general-welfare police-power hook for municipal regulation; SDCL Chapter 6-12 charters (Sioux Falls, Rapid City, Watertown) carry equivalent authority; SDCL Chapter 11-2 covers unincorporated county areas through zoning. As of 2026 review, no South Dakota city has adopted a California-style gas-blower phase-out; the typical local rule (where one exists at all) folds leaf blowers into the city's general construction-and-yard-equipment noise window (e.g., no operation before 7 a.m. or after 10 p.m.).

State law provides no leaf-blower-specific penalty. If operation rises to 'unreasonable noise' made with purpose to cause public alarm, SDCL 22-18-35 (Class 2 misdemeanor) applies. Local-ordinance fines (where adopted) are typically civil, $50-$250 per violation.
