South Dakota state law: garage-sale and temporary event signs

South Dakota state law does not address residential garage-sale or temporary event signage. Local sign codes — adopted under SDCL Chapter 11-4 for statutory cities, under SDCL 6-12 charters for home-rule cities, and under SDCL Chapter 11-2 for counties — typically permit temporary garage-sale signs subject to limits on: size (commonly 4-6 sq ft), location (on the host property and sometimes on public right-of-way for limited windows), number, and duration (typically allowed only for the day(s) of the sale plus a short setup/takedown window). Many cities prohibit sign placement in the public right-of-way (sidewalks, utility poles, traffic-sign posts, medians) and in vision-clearance triangles at intersections. Signs nailed or stapled to utility poles are typically prohibited under SDCL 49-34A (utility regulation) and local code. SDCL Chapter 31-29 (Advertising Adjacent to Highways) implements the federal Highway Beautification Act and prohibits commercial off-premises signs within 660 feet of the interstate or federal-aid primary right-of-way without permit; off-premises temporary garage-sale signs in highway right-of-way are unlawful. Local ordinances enforcing temporary-sign limits must be content-neutral under Reed v. Town of Gilbert, 576 U.S. 155 (2015) — restrictions must apply equally to all temporary signs (garage sale, political, real-estate, ideological) without content-based distinctions that would trigger strict scrutiny.

There is no state-level penalty for unlawful residential temporary signs. Local code enforcement typically removes signs found in public right-of-way without prior notice. Repeated violations may incur per-violation administrative fines under local code authorized by SDCL Chapter 9-32 (municipal nuisance powers). Posting commercial garage-sale signs within 660 feet of an interstate or federal-aid primary highway without a permit violates SDCL Chapter 31-29 and is subject to South Dakota Department of Transportation removal and penalty under SDCL 31-29-77 et seq.
