South Dakota state law: bulk and large-item disposal

Under SDCL 34A-6-67 (effective 1995), yard waste, lead-acid batteries, waste motor oil, and white goods are banned from disposal in South Dakota municipal solid waste landfills. White goods (major appliances containing ferrous metal) must be collected separately and recycled — most SD cities and counties operate seasonal appliance drop-off days or accept appliances at the transfer station for a per-unit fee. Lead-acid batteries must go to retailers or auto parts stores under the state battery take-back framework. Mattresses, furniture, carpet, and construction and demolition (C&D) debris are not subject to the SDCL 34A-6-67 landfill ban and are generally accepted at permitted municipal solid waste landfills and C&D facilities under SDCL Chapter 34A-6 (Solid Waste Management). Bulk pickup at the curb (couches, mattresses, large bagged items beyond cart capacity) is a city-level service — Sioux Falls, Rapid City, and Aberdeen all operate scheduled bulk-collection or appointment-based programs under SDCL 9-32-11. Tires are regulated under SDCL Chapter 34A-6 with specific facility requirements; most SD cities cap residential disposal at 4 tires per year and charge per-tire fees beyond that. Hazardous household waste (paints, solvents, pesticides) must not be landfilled and is collected through county or regional household hazardous waste events.

Disposing of white goods, lead-acid batteries, yard waste, or used motor oil in a landfill violates SDCL 34A-6-67 and subjects the generator and the facility to SDCL Chapter 34A-6 enforcement (administrative penalties, civil suit by the State). Illegal dumping of bulk items outside a permitted facility violates SDCL 34A-6-87 — under 10 pounds is Class 2 misdemeanor littering (SDCL 34A-7-6); 10–2,000 pounds is Class 1 misdemeanor illegal dumping; over 2,000 pounds knowingly is a Class 6 felony.
