South Dakota state law: trash pickup rules and collection authority

SDCL 9-32-11 authorizes every municipality to collect and dispose of and regulate the manner of handling garbage and other waste material, to acquire, establish, maintain, operate and regulate equipment and garbage disposal plants, incinerators and dumping grounds, to fix and collect charges for such services, and to contract with one or more persons for the collection and hauling of garbage and other waste material from the municipality or districts. The South Dakota Supreme Court in Byre v. City of Chamberlain (1985) confirmed that statutes and ordinances dealing with collection and disposal of waste are health measures and that municipalities possess broad authority to regulate by ordinance to preserve community health. Home-rule cities (Sioux Falls, Rapid City, Watertown) operate under SDCL 6-12 charter authority and typically contract with private haulers or operate municipal collection (Sioux Falls Code Chapter 57 governs garbage and recycling). Statutory cities act under SDCL 9-32-11 plus SDCL 9-29-1 general welfare authority. Counties may regulate solid waste in unincorporated areas under SDCL Chapter 11-2 (county zoning) and SDCL Chapter 34A-6 (state solid waste permits). Rural farmers and ranchers may dispose of domestic waste on their own property without a state permit if the disposal does not threaten health, environment, or water quality (DANR guidance under SDCL 34A-6).

No state penalty for missed pickup or non-participation; enforcement is by municipal ordinance. SDCL 34A-6-87 makes willful disposal of solid waste inconsistent with chapter requirements unlawful — under 10 pounds is littering (Class 2 misdemeanor under SDCL 34A-7), 10–2,000 pounds is illegal dumping in the second degree (Class 1 misdemeanor), and over 2,000 pounds knowingly is illegal dumping in the first degree (Class 6 felony).
