Utah Agricultural Operations and Backyard Poultry Preemption

Utah Code Title 17, Chapter 41 establishes Agricultural Protection Areas (APAs) where agricultural activities, including raising poultry and livestock, are protected from local ordinances that would unreasonably restrict farm operations. Utah's Right to Farm Act (Utah Code 78B-6-1101 through 1104) prevents agricultural operations from being declared nuisances when they predate surrounding development. Municipalities may regulate backyard chickens through zoning in residential districts, but state law preempts unreasonable limits in agricultural zones. Cities cannot retroactively impose restrictions on operations within an APA.

Violating local poultry zoning rules typically triggers civil infractions and abatement; nuisance suits against protected agricultural operations are barred by statute.
