Utah Bans Home Cannabis Cultivation Statewide

Under Utah Code Title 58, Chapter 37 (Controlled Substances Act) and Title 26B, Chapter 4, Part 2 (Cannabinoid Product Board and Medical Cannabis Act), cannabis remains a Schedule I controlled substance for non-medical use. The Medical Cannabis Act allows qualifying patients with a Medical Cannabis Card to purchase product only from licensed Medical Cannabis Pharmacies. Home cultivation by patients, caregivers, or any private individual is not authorized. Recreational cannabis is fully prohibited. Cultivation of any quantity is a third-degree felony, with higher classifications based on weight and circumstances such as proximity to schools. Local governments cannot legalize home growing.

Unlicensed cultivation is a third-degree felony for any amount; cultivation of 100+ plants or near schools triggers second-degree felony charges and federal exposure.
