Utah operates a limited medical cannabis program under Utah Code §26B-4 (formerly Title 26, Chapter 61a). Qualifying patients with a Medical Cannabis Card may purchase from state-licensed medical cannabis pharmacies (14 statewide as of 2024). Home cultivation is specifically prohibited—Utah Code §58-37-8 makes growing cannabis a felony regardless of quantity or patient status. First offense of 1–100 plants is a 3rd-degree felony (up to 5 years prison + $5,000 fine); 101+ plants is 2nd-degree felony. Recreational cannabis remains fully illegal for adults. Federal law (Controlled Substances Act, 21 U.S.C. §841) also prohibits cultivation. Medical patients caught growing lose their card immediately. CBD products ≤0.3% THC are legal under Utah Code §4-41-401 (industrial hemp) and may be purchased retail.
