New Jersey's Swimming Pool and Spa Code, Section 305.5, lets an onground pool wall act as the required barrier when the wall sits on grade and rises at least 48 inches above grade around the entire perimeter. Ladders or steps used for access must be surrounded by a compliant barrier, and any opening left by securing, locking, or removing them cannot pass a 4-inch sphere. This is the rule in Bridgewater, Franklin Township, and Somerville. The pool is still a structure, so N.J.A.C. 5:23-2.14 requires a construction permit and pump bonding inspection.
Leaving an access ladder unsecured on an above-ground pool is a cited barrier defect. A pool wall under 48 inches without an added barrier fails inspection and cannot be filled.
