Per LDC 5.02.05.A.2.a, the structure of an above-ground swimming pool may be used as its barrier, or a barrier may be mounted on top of the structure, provided it meets all barrier requirements of the section. Any ladder or steps that are the means of access must be capable of being secured, locked, or removed to prevent access, or must be surrounded by a barrier meeting the requirements. Above-ground pools still follow the side/rear-yard location rule and the Florida Building Code barrier standards. A drainage plan is not triggered the way it is for in-ground pools on small lots.
Leaving an above-ground pool ladder in place without a compliant barrier is a code-enforcement violation and a state safety-act violation; correction is required after notice.
