Above-ground pools still need a barrier under Michigan's Residential Code. If the pool wall serves as the barrier and access is by ladder or steps, the ladder must be removable, lockable, or fenced so children cannot climb in when the pool is unattended.
Above-ground pools are treated like any pool under the statewide Michigan Residential Code, enforced by your local building department. A building permit is required if the pool holds water 24 inches deep or deeper. When the above-ground pool structure itself acts as the barrier, or a fence is mounted on top of it, the gap between the pool top and the fence bottom must not exceed 4 inches. If the only access is a ladder or steps, they must be capable of being covered, locked in an unusable position, or removed, or be surrounded by a compliant 48-inch fence with a self-latching gate. Any openings left when the ladder is secured must not pass a 4-inch sphere.
Leaving a ladder or steps accessible on an unattended above-ground pool is a barrier-code violation; the local building department can order corrective measures before use.
