New Brunswick, NJ Swimming Pools & Spas: Pool Permits (2026)

The permit fees come from Section 15.04.120, Construction permits and fees, part of the Uniform Construction Code chapter, with fees payable to the City of New Brunswick at the central permit office. Under the Building Subcode Fees heading, swimming pools are priced among the structures whose volume cannot be computed: $125.00 for an in-ground pool in use group R-5, $400.00 for an in-ground pool in all other use groups, and $200.00 for an above-ground pool in any use group. The same section prices electrical work separately: annual swimming pool, spa, hot tub inspection costs $150.00, and bonding of inground swimming pools costs $100.00.

Zoning treats the pool as an accessory structure. Section 17.03.110 says private swimming pools designed and intended for the sole use of site occupants and their guests are accessory structures for the purpose of securing permits. Section 17.03.040 then keeps accessory structures out of any required front yard and caps the aggregate ground area covered by accessory structures in a required rear yard at thirty (30) percent of the required rear yard area in a residential zone. Section 17.08.030 requires the zoning officer to issue a zoning permit before a building permit. The initial zoning permit fee for single- and two-family residential use is $30.00, and a resubmission is free within 45 days of a denial and $15.00 after that.

Chapter 15.28 sets the build standards. Its definition covers portable pools and any wading pool capable of a minimum depth of twelve (12) inches. Every pool needs a fence or wall not less than four feet high with no openings larger than three inches, and gates must be self-closing or self-latching and padlocked when the pool is not in use. Above ground and decked pools with a top forty-eight (48) inches or more high are excused from the fence if steps, ladders and other access are removed when the pool is not in use. Water left in a pool through the non-swimming season needs a safety cover that supports at least one hundred fifty (150) pounds at every point, and Section 15.28.120 adopts the Swimming Pool Code of New Jersey-1970.
