Miami applies the federal Tobacco 21 law (Dec 2019) and Florida SB 1080 (effective Oct 1, 2021), which raised the state minimum legal age for sale and possession of tobacco and nicotine products to 21. Florida Statutes Β§569.0073 and Β§877.112 govern tobacco and electronic nicotine delivery system (ENDS) sales statewide and require retailers to obtain a Tobacco Retail Dealer permit from the Department of Business and Professional Regulation (DBPR), Division of Alcoholic Beverages and Tobacco. Florida law broadly preempts local regulation of tobacco product sales, so Miami has no city flavor ban or independent retailer license. Retailers must post DBPR-prescribed age signage and check photo ID for any purchaser appearing under 30. DBPR conducts random compliance inspections using underage decoys. Active-duty military 18+ at the time SB 1080 took effect are grandfathered.
Florida Statute Β§569.101 imposes retailer fines of $500 for a first offense, $750 for a second within 24 months, $1,000 for a third, and permit suspension or revocation for repeated violations. Civil penalties may also apply to clerks. Furnishing tobacco to anyone under 21 is a second-degree misdemeanor with fines up to $500. Failure to post age signage is a separate $100 violation.
